The Pretoria High Court has declared Home Affairs Minister Aaron Motsoaledi’s decision to terminate the Zimbabwean Exemption Permit (ZEP) as unlawful, unconstitutional and invalid.
The court also granted the Zimbabwe Immigration Federation an interim interdict preventing ZEP holders from being arrested or deported for now. ZEP permit holders will now have another 12 months to remain in South Africa without fear of reprisal or arrest as the court orders the Department to conduct a proper public participation process as required by law.
